Terms of Use

These terms govern your use of the Athlync website at athlync.com and its subdomains (the “Site”), operated by Athlync, Inc. By using the Site or joining the waitlist you agree to them. If you do not agree, please do not use the Site.

The Athlync mobile application has not launched. Separate terms will apply to it, and you will be asked to accept those before creating an account.

What the Site currently offers

The Site is promotional. It describes a product under development and lets you join a waitlist to be notified when it launches. Joining the waitlist does not create an account, does not reserve anything, does not guarantee access, and does not oblige us to launch. Features described on the Site are plans, not commitments, and may change or be dropped.

Using the Site

You agree not to:

• Submit false information, or someone else’s information without their permission.
• Submit automated, bulk or repeated signups, or otherwise interfere with the operation of the Site.
• Attempt to gain unauthorised access to the Site, its data, or its underlying systems.
• Copy, scrape, or redistribute the Site’s content for commercial purposes.

We may remove any signup and restrict access to the Site if these terms are breached.

Eligibility

You must be at least 13 years old to submit information through the Site. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or guardian.

Communications

By joining the waitlist you agree that we may email you about Athlync’s launch and early access. Every email includes a way to unsubscribe, and you can opt out at any time by contacting support@athlync.com. We will not use your address for unrelated marketing.

Intellectual property

The Athlync name, logo, and the Site’s design, text and graphics belong to Athlync, Inc. or its licensors, and are protected by intellectual property laws. Using the Site does not transfer any of those rights to you.

Third-party services

The Site relies on services operated by third parties, including Firebase Hosting and Cloud Firestore (Google LLC) and, for the sport interest surveys, Google Forms. Those services are governed by their own terms, and we are not responsible for them. See our Privacy Policy for what this means for your data.

Disclaimer

The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Athlync, Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the Site. Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, or for death or personal injury caused by negligence.

Changes

We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the Site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
